According to a recent US Supreme Court decision for the state of Pennsylvania, which reversed an earlier court decision on the subject, invalid ballots will not be tallied in the November midterm elections in one state.
That means that unlike in 2020, incomplete or incorrect mail-in ballots won’t be added to the total this time around, which has the Democrats in a tizzy.

In a judgeship election issue, the US Supreme Court sided with a Pennsylvania Republican.
According to the Associated Press, the Supreme Court overturned a lower court decision that permitted the counting of mail-in ballots without dates.
As sought by David Ritter, who lost his candidacy for a position on the Lehigh County Court of Common Pleas in 2021 by a margin of five votes when 257 absentee ballots without date notations were counted, the justices overturned the decision of the 3rd U.S. Circuit Court of Appeals in Philadelphia.
Following the high court’s decision, the three states governed by this regional federal appellate court — Pennsylvania, New Jersey, and Delaware — cannot use the 3rd Circuit decision as a precedent to allow the counting of ballots with minor errors like the voter failing to fill in the date.
The Dr. Oz campaign in Pennsylvania understood that the lower court’s decision was incorrect and would have a detrimental effect on upcoming elections in the state, therefore they sided with David Ritter in his appeal.
However, the Oz campaign filed a brief in David Ritter’s favor as a judicial candidate.
His lawyers claimed that “The Third Circuit’s thinly reasoned and erroneous decision — which addressed a county judicial election conducted more than six months ago — is now being weaponized to undermine the apparent result of a statewide primary election for the Republican nomination to represent Pennsylvania in the United States Senate.”
According to Politico, a three-judge panel on the 3rd Circuit Court of Appeals ruled in May that election officials should count several hundred mail-in ballots for a county judge election that were received on time but did not include a date on the envelopes.
Pennsylvania’s elections are absurd and always have been.
The state’s election process was in appalling condition, according to the auditor of the state’s 2019 report.
