    U.S. Supreme Court Agrees to Hear Challenge Against New York’s Vaccine Mandate

    Because the U.S. Supreme Court has agreed to consider a challenge to its Constitutional authority, New York City’s onerous COVID-19 vaccination requirement may soon be overturned.

    “Workers in New York City who perform in-person work or interact with the public in the course of business must show proof that they have received a COVID-19 vaccine. Businesses may not allow any unvaccinated workers to work at their workplace,” reads the current vaccine mandate for NYC.

    Effective March 7, 2022, the order has been modified to indicate that New York City will no longer require anyone aged 5 and older to present immunization documentation to attend indoor eating, exercise, entertainment, and meeting places. The declaration made by Mayor Eric Adams on February 27, 2022, is excellent news for the proprietors of several hospitality venues who have been handicapped by the ever-changing rules set by former Mayor Bill de Blasio the previous year.

    The statement from Adam’s office reads:

    “Although the Key to NYC requirements have changed throughout the pandemic, since August 17, 2021, no “ may admit a patron, full- or part-time employee, intern, volunteer, or contractor to enter its premises without presenting evidence of COVID-19 immunization. The rule applies to Indoor Food Services, Indoor Gyms and Fitness Facilities, and Indoor Entertainment and Recreational Facilities.

    Any entity found to have breached the Key to NYC requirement is liable to a minimum $1,000 fine for a first offense, $2,000 for a second occurrence within 12 months, and $5,000 for any subsequent offense within 12 months. Each time a covered entity fails to check the immunization status of a person is deemed a separate violation of the order.

    Private Sector Order – NOT to be Lifted on March 7

    As described in this article, on December 13, 2021, the city issued a further expansive Executive Order affecting the majority of the city’s private enterprises. This order, which is still in effect and will not be rescinded on March 7, 2022, requires every non-government entity that employs more than one worker in the city or maintains a workplace in the city to ensure that all of its “workers” present proof of vaccination against COVID-19 before entering the workplace.

    This order defines “worker” as a person who physically works in the city, including full- or part-time staff members, employers, employees, interns, volunteers, and contractors of a covered entity. The directive also applies to independent contractors or solo practitioners who operate in a public workplace or deal with other employees or the general public as part of their company.
