    Special Counsel John Durham Team Reveals Major October Surprise

    Some people’s perceptions of a potential new path the case is taking have been changed by the addition of a new member to the Special Counsel team who is receiving significant media attention and has extensive experience in RICO cases.

    A 2015 press release described the RICO prosecutor Durham is hiring, who has experience conducting RICO investigations.

    CAMDEN, N.J. – Two Texas men who were convicted along with a member and an associate of the Lucchese organized crime family of La Cosa Nostra (LCN) were sentenced today to prison terms for their respective roles in a racketeering conspiracy and related offenses, U.S. Attorney Paul J. Fishman announced. ”

    John Maxwell, 63, of Dallas, Texas, was given a 10-year prison term; William Maxwell, 56, of Houston, Texas, received a 20-year prison term. Following a six-month trial before U.S. District Judge Robert B. Kugler, who handed down the sentences today in Camden federal court, the Maxwells, along with Nicodemo S. Scarfo, 50, of Galloway, New Jersey, and Salvatore Pelullo, 48, of Philadelphia, were found guilty in July 2014 of racketeering conspiracy and related offenses, including securities fraud, wire fraud, mail fraud, bank fraud, extortion, money laundering,

    Small takes over for Andrew DeFilippis, who departed due to another trial. To “increase criminal culpability for a number of ‘predicate offenses,'” the RICO Act is used.

    Small, a native of Baltimore who is now 33 years old, began working with the DOJ’s Organized Crime and Gang Section in the fall of 2011. Small earned a B.A. in history from Columbia University in 2004 and taught history and English for two years at a private school in northern New Jersey before enrolling in Georgetown Law School, from which he graduated in 2009. Small then worked as a judicial assistant in Baltimore for a US District Court judge.

    “Special Counsel John Durham’s team, added a new member as another high-profile trial is underway. Durham potentially has an “October surprise” as another main figure could be charged for his role with the discredited dossier, which played a role in the Trump-Russia investigation,” Martin Walsh reported for Conservative Brief.

    Adam Small was added to the team after Andrew DeFilippis, an assistant special counsel, withdrew from the team ahead of the trial of Russian national Igor Danchenko. Small’s official LinkedIn page says he is a “Trial Attorney with experience prosecuting Espionage Act, trade secret/economic espionage, sanctions/export control, FARA, wire fraud, money laundering, cyber, and RICO offenses.”

    The areas of competence for Small include RICO, FARA, money laundering, and economic espionage.

    Since the November indictment, DeFilippis had been heavily involved in the Danchenko case, appearing in court, participating in virtual sessions, and filing paperwork, among other things. Danchenko faced five counts of making false statements to the FBI last year. According to Durham, the remarks related to the data Danchenko gave for the dossier.

    The monitor for the Department of Justice came to the conclusion that Danchenko ultimately disproved Steele’s erroneous assertions that there was a “well-developed conspiracy” between Russia and the late President Donald Trump.

    According to The Week:

    Igor Danchenko, a researcher on Russian foreign affairs, was accused by Durham of five counts of lying to the FBI in connection with his work as a sub-source for the infamous and largely debunked Trump-Russia dossier authored by former British spy Christopher Steele.

    Much like he did during the trial, Durham focused much of his closing statement on criticizing the FBI and Special Counsel Robert Mueller’s probe.  Josh Gerstein of Politico observed last week that “Durham seemed to be training his fire on the FBI, even at the expense of his case against Danchenko.” As Durham defended his work and attacked the FBI and Mueller inquiry during Monday’s final remarks, Judge Trenga, a George W. Bush appointee, reportedly warned him, “You should finish up,” according to The New York Times.

    The jury deliberated for four hours Monday in federal court in Alexandria, Virginia after the attorneys for Durham and Danchenko finished their final statements. The jury was then dismissed for the evening.

    Sen. Ron Johnson of Wisconsin, a Republican, claimed that Durham’s inquiry has “hindered Congress as lawmakers seek to root out FBI misconduct and examine the shady business dealings of Hunter Biden.”
    Blame was assigned during a recent interview on Newsmax where Johnson complained about the lack of successful prosecutions in Durham’s investigation, which appears to be coming to an end as the prosecutor takes the alleged primary source for the now-famous dossier alleging ties between the former president Donald Trump and Russia to court this month. The senator expressed his dissatisfaction, citing the fact that attorney Michael Sussmann, who was acquitted in May, was not found guilty, according to the Washington Examiner.

    “Our efforts in terms of investigating Hunter Biden, and corruption within the FBI was certainly hampered because we had an active criminal investigation under John Durham,” Johnson said.
