New Trump Special Prosecutor Overturned By Supreme Court, Tied To IRS Scandal

    Published on

The only thing that has come out of the pointless investigations into former president Donald Trump in relation to the Jan. 6 incident at the Capitol and the “classified documents” discovered at Trump’s residence Mar-a-Lago is further investigation.

Trump himself claims that the FBI “failed to find anything on me regarding the Jan 6 Hoax, or the Document Hoax,” and the previous president has claimed that he personally declassified the records before leaving the White House.

With the selection of a new special prosecutor by AG Merrick Garland, the inquiries are now attempting to go forward.

Attorney General Garland appointed Jack Smith, a war crimes prosecutor in The Hague and a former head of the DOJ’s public integrity division, to lead two investigations into Trump on Friday. However, the appointment is just as clouded by controversy as the inquiries.

The special counsel appointed by the Biden administration to look into Donald Trump oversaw a Justice Department division that received criticism from the Supreme Court for prosecuting a prominent Republican and was connected by Congress to the IRS controversy that targeted right-leaning organizations. Smith has connections to several contentious situations, including an earlier IRS controversy.

The House Oversight Committee came to the conclusion in 2014 that during Smith’s earlier tenure at the DOJ, he orchestrated a crucial meeting between his department and IRS official Lois Lerner, which sparked the targeting of conservative nonprofits that later became one of the Obama administration’s signature scandals.

Following the landmark Citizens United free speech Supreme Court case, the Oversight Committee acquired testimony from a DOJ official called Richard Pilger in 2014 that demonstrated Smith scheduled a meeting with Lerner to discuss more aggressive enforcement of rules barring tax-exempt organizations from participating in politics.

“According to Mr. Pilger, the Justice Department convened a meeting with former IRS official Lois Lerner in October 2010 to discuss how the IRS could assist in the criminal enforcement of campaign-finance laws against politically active nonprofits,” the committee noted in a 2014 letter to DOJ. “This meeting was arranged at the direction of Public Integrity Section Chief Jack Smith.”

The letter concluded: “It is apparent that the Department’s leadership, including Public Integrity Section Chief Jack Smith, was closely involved in engaging with the IRS in wake of Citizens United and political pressure from prominent Democrats to address perceived problems with the decision.”

The letter, which sought a transcribed interview with Smith, was signed by then Committee Chairman Darrell Issa (R-Calif.) and Rep. Jim Jordan (R-Ohio), who is now in line to become House Judiciary Committee chairman when the GOP takes over the House in January.

The Treasury Department Inspector General ultimately concluded that the ensuing IRS pursuit of conservative nonprofits was inappropriate.

“The IRS used inappropriate criteria that identified for review Tea Party and other organizations applying for tax-exempt status based upon their names or policy positions instead of indications of potential political campaign intervention,” the report concluded. CONTINUE READING…
