    Judge Unexpectedly Delays Fox News vs. Dominion Trial Just Before It Was Set to Start

    The trial in the litigation between Dominion Voting Systems and Fox News has been postponed.

    According to The Wall Street Journal, Superior Court Judge Eric Davis of Delaware announced late Sunday that the trial would begin on Tuesday instead of Monday.

    As the trial date approached, the Journal reported that Fox was attempting to reach a settlement, citing “people familiar with the situation.”

    The Journal suggested that Dominion may have shifted its position when it sought $1.6 billion in damages.

    Dominion notified Fox in a letter appended to a Fox News filing that it would no longer seek at least $600 million in lost profits from a jury.

    The Dominion lawsuit is based on Fox’s 2020 election coverage and claims that Fox knew assaults on its voting systems were false, but still aired them.

    According to unnamed sources cited by The Washington Post, the two parties will convene on Monday for a final attempt to reach a settlement.

    According to a report from The Post, Dominion has indicated that it will demand an admission from Fox that it broadcast false information.

    As of Saturday, Dominion had not publicly indicated that it desired a settlement.

    “In the coming weeks, we will prove Fox spread lies causing enormous damage to Dominion. We look forward to trial,” a Dominion spokesman said, according to CNBC.

    Fox has called Dominion’s lawsuit “a political crusade in search of a financial windfall.” The network has said it has First Amendment protection, according to Axios.

    According to the Journal, Davis has already given Dominion some advantages in this case. He has already ruled that both guest and network host statements broadcast by Fox regarding Dominion were deceptive.
