    Joseph: With Biden’s Memory Fading, He Needs to Be Reminded About the Supreme Court’s Power

    Recently, Vice President Joe Biden bragged, “I have a pen that can veto.”

    But given his failing memory, it might be necessary to remind him that the judiciary has the authority to review his vetoes and determine if they are lawfully constitutional.

    A Supreme Court ruling cannot be overridden by the president’s veto or an executive order under the checks and balances system in the United States. The legal system has the final say in matters of legislation.

    All Americans need to keep this in mind. After gaining a narrow Senate majority in the most recent midterm elections, the happy Democrats must restrain themselves from going overboard.

    The extreme “rights” agenda being promoted by the Democrats must be restrained, and the Supreme Court bears a heavy responsibility in this regard.

    The founding fathers understood the benefits of having three distinct branches of government.

    The federal government should uphold “the political maxim, that the legislative, executive and judiciary departments ought to be separate and distinct,” according to James Madison in The Federalist No. 47 from way back in 1788.

    The judicial branch assesses whether the other branches have behaved in accordance with enshrined constitutional principles. The legislative branch creates the laws, the executive branch executes them, and the judicial branch makes the laws.

    And right now, that knowledge is desperately required.

    The House may deploy its oversight and appropriations committees over the next two years. Much of the damage caused by Biden’s first two years can be undone if used wisely and effectively.

    However, the Supreme Court’s authority is crucial.

    Biden’s pledge to make abortion legal

    Prior to the midterm elections, Biden bragged that if the Democrats took back the House, one of his first moves would be to formalize “abortion rights.” He was unaware of the constitutional intricacies surrounding so-called rights in relation to abortion, though.

    The established and formally agreed-upon legal norms in a constitutional republic cannot be altered by a majority of democratic ballots. For instance, the fundamental “no property in man” premise at the core of the 13th Amendment cannot be repealed by a majority vote. A return to legal slavery cannot be approved by majority votes or new legislation. Furthermore, the majority of votes and new laws cannot legalize abortion or grant people the right to own and kill the youngest and tiniest humans—members of “our posterity”—while they are still inside their mothers.

    When a president signals before an election that he has no intention of entering into any bipartisan consideration of bills he dislikes, and will use his veto power to kill those bills, then it is the judicial branch that must use its non-partisan authority to pull the president into line with his constitutional duties.

    The complex role of the Supreme Court in the U.S. system of government lies in its authority to invalidate legislation or executive actions that, in the court’s considered judgment, conflict with the Constitution.

    In a constitutional republic, no majority can render constitutional a bill that is unconstitutional, and it is the Supreme Court’s serious responsibility to judge such cases and to require Congress to amend the Constitution or alter the bill. CONTINUE READING…
