    Federal judge BLOCKS most of New York’s new gun law which imposes stringent controls

    On Thursday, a federal judge rejected a portion of a restrictive new gun law that invaded residents’ privacy and threatened them with felonies – even when gun owners had a licence to carry. This was a victory for Gun Owners of America (GOA).

    The judge granted permission for the advocacy group to file a lawsuit opposing the law with Marxist roots. Marxists, such as the New York General Assembly and Governor, want both local and federal control over firearms. Local control would allow them to undermine citizens’ rights guaranteed by the US Constitution while federal control would allow them to maintain population control, such as when they want to cut funding for local police departments.

    GOA issued the following statement on their website on Thursday:

    Today, Gun Owners of America (GOA) and Gun Owners Foundation (GOF) secured a temporary restraining order in federal court against the poorly named New York “Concealed Carry Improvement Act.” This follows GOA and GOF re-filing their lawsuit against New York just two weeks ago.

    The following clauses of this law are prohibited by this TRO:

    • Requiring businesses to openly state they ALLOW concealed carry
    • Disclosing one’s social media accounts for review
    • Prohibitions on carrying in most so-called “sensitive places,” including doctor’s offices, Times Square, restaurants and places of entertainment, and on public transportation
    • In-person interviews with law enforcement

    In the absence of a federal circuit court reversing this decision prior to next week, the TRO will go into force.

    Senior Vice President of GOA, Erich Pratt, released the following statement:

    “Anti-gunners like Kathy Hochul and Eric Adams lied and misrepresented the Second Amendment to the courts, putting New Yorkers at a great disadvantage in the midst of rising crime. We are grateful to Judge Suddaby for his quick action to restore the right of the people to keep and bear arms. Once the TRO goes into effect, GOA encourages New Yorkers to exercise their rights and to defend themselves and the ones they love.” 

    Sam Paredes added the following on behalf of the Gun Owners Foundation’s board of directors:

    “New York doubled down to infringe on the Second Amendment in direct contradiction of the edicts from the U.S. Supreme Court. GOA and GOF are thankful to be vindicated by Judge Suddaby, who helped restore gun rights today. GOA and GOF will continue to fight for the rights of the people until Albany sets aside anti-gun hysteria and supports their citizens’ unalienable right to self-defense, as guaranteed by the Second Amendment.”

    Media reports, such as this one from BillyPenn, claim that GOA has been successful in other states where municipal governments have overstepped their bounds:

    “Why Gun Owners of America keeps winning in Philadelphia, blocking local firearms regulation”

    After overturning the prohibition on recreation centers, the group’s Pa. GOA director declared, “We stopped Mayor Kenney in less than a week, and we will do the same to you.”

    “After Philadelphia recreation employee Tiffany Fletcher was shot and killed at work last month, Mayor Jim Kenney banned guns at city pools and rec centers.

    Less than a week later, his rule was thrown out by a Philadelphia court.

    The judge who issued the decision seemed to do so begrudgingly. In his opinion, Judge Joshua Roberts wrote he was “duty-bound to uphold the law” — referencing Pennsylvania’s Uniform Firearms Act, which says Pa. municipalities can’t enact their own gun regulations.”

    Revisiting the New York Law

    “The law came into effect on September 1, creating new requirements for obtaining a license, including submitting social media accounts for review, and creating a long list of public and private places where having a gun became a felony crime, even for license holders, The Daily Mail reported on the details, adding:

    “U.S. District Judge Glenn Suddaby focused on multiple parts of the law, saying licensing requirements – like a rule requiring applicants to turn over information about their social media accounts – went too far.

    He argued that the Empire State’s latest rules interfered too much with Americans’ Second Amendment right to bear arms.

    ‘Simply stated, instead of moving toward becoming a shall-issue jurisdiction, New York State has further entrenched itself as a shall-not-issue jurisdiction. And, by doing so, it has further reduced a first-class constitutional right to bear arms in public for self-defense… into a mere request,’ wrote Suddaby, who sits in Syracuse.”

    The court’s decision would maintain the ban on bringing firearms into public venues like schools, offices, and houses of worship, but the judge said that the state couldn’t forbid them from entering other sensitive areas like Times Square.

    The judge ordered the state three business days to ask a federal appeals court for immediate relief.

    The rules were part of a sweeping gun law that went into effect Sept. 1 designed to protect public safety while adhering to a U.S. Supreme Court ruling that invalidated New York’s old system for granting permits to carry handguns outside the home.

    Gov. Kathy Hochul and the state Legislature approved the law this summer shortly after the high court struck down a state law that required people to demonstrate an unusual threat to their safety to qualify for a license to carry a handgun outside their homes. CONTINUE READING…
